Claim number: 570MC490

Parties: MRS Mervelee Myers Vs Housing Ombudsman Service

Your telephone mediation appointment

Appointment date: 25/10/2024

Appointment time slot: 12:00 to 14:00

Your confidential telephoneโ€ฏmediationโ€ฏappointmentโ€ฏhas been booked for the above date and time slot. This means that the mediator will call you between the times shown. Your appointment will last for around one hour from the point at which the mediator calls.

The mediator will call both parties separately โ€“ you will not talk directly to the other side. They will try to help you both come to an agreement before the case goes to court.

Where your mediation appointment is mandatory, If you do not attend the appointment, the judge will take this into consideration at any court hearing and may issue a penalty. This could include the judge automatically ruling in the other partyโ€™s favour or ordering you to pay for some or all the other partyโ€™s costs. MM Response: Want to put on record that I became the victim of HMCTS District Judge Sterlini who labelled me a VIOLENT NUISANCE. He strike out my claim with Winsome Duncan who stolen my manuscript after it reached Telephone Mediation.

Preparing for your appointment

You must make sure you have provided us with, or confirmed, the name and number of the person who will be conducting the mediation appointment.ย If you have not done this, or need to update your telephone number, you should contact us using the details at the end of this letter no less than 5 working days before your mediation appointment. Failure to do so may result in your mediation appointment not taking place and may result in a Judge issuing a penalty where the mediation was mandatory. MM Response: MM is always the one penalised.

The mediator will call from a withheld number. Make sure that withheld numbers are not blocked on your phone.

Be ready to receive a call from the mediator from the beginning of your time slot. The mediator will call the telephone number you provided in your application.

If the mediator cannot contact you within 10 minutes of the appointment start, the appointment will be cancelled and you may, where mediation is mandatory, face a penalty for non-attendance. MM Response: No allocations given for disabilities. How do I know I won’t face the KINDS of TRICKERY I experienced the past 10 years?

Rebooking your appointment

If you need to rebook your appointment, you must have a good reason. The administration team will only consider rebooking in exceptional circumstances, such as an accident or a family bereavement. You must let us know as soon as possible.

Nominating a different representative

If you want someone else to represent you atโ€ฏmediationโ€ฏ(like a trusted friend, relative or a solicitor) you must contact the mediation team

If you want to choose someone to attend your mediation appointment on your behalf who is not a part of the claim or is not a legal representative, you will also need to complete a delegated authority form. You can find out more about this on GOV.UK.

Your representative must know the facts of the case, understand how far youโ€™re willing to compromise and have full authority to act on your behalf. Youโ€™re legally bound to any settlement agreements your representative makes on your behalf.

What happens in yourโ€ฏmediationโ€ฏappointment?

Introduction from the mediator

The mediator will introduce themselves and check that you have read and understood theโ€ฏmediation process.

Explaining your position

You will need to briefly explain your claim or defence to the mediator. You should prepare for yourself a brief summary of the main points. MM Response: I will be on my guard.

Negotiating optionsโ€ฏ

Youโ€™re attendingโ€ฏmediationโ€ฏwith a view to settling your case. This means negotiating to overcome disputed issues. The mediator is neutral and helps each party to explore options and discuss risks.โ€ฏMediationโ€ฏworks when youโ€™re willing to listen to what the other party has to say, negotiate and agree a settlement. MM Response: If HMCTS had not been party to the unlawful injunction and HOS had not failed we would not be here.

Building agreement

Settlement can be in many different forms, for example, payment, goods or work. Both parties must agree on the outcome and feel they have reached an acceptable resolution. MM Response: I will state in advance I need compensation for 23 years of HATE CRIMES.

Reaching a settlement

The mediator will read the terms of the settlement and confirm agreement with each party. Once agreed, the settlement is legally binding and cannot be changed.โ€ฏA copy of theโ€ฏmediationโ€ฏsettlement is sent to both parties and placed on the court file. MM Response: Let me hope I get paid and this do not end like the judgement with Barrister Ryan Clement. Am still waiting to be paid and getting threats from Court Enforcement Services.

Confidentiality

Allโ€ฏmediationโ€ฏappointments are confidential. An agreed settlement includes a standard confidentiality clause. MM Response: Only Mervelee Myers is to keep CONFIDENTIAL.

Ending theโ€ฏmediationโ€ฏprocess

The mediator can end theโ€ฏmediationโ€ฏif, at any time:

  • either party breaches the terms on which they agreed toโ€ฏmediation
  • there is no prospect that theโ€ฏmediationโ€ฏwill end in settlement
  • the mediator deems it inappropriate to continue in the case that one or both parties are vulnerable users
  • either party asks to endโ€ฏmediation

Your mediation appointment will be conducted in 5 stages as set out below.

Stage one: Introduction: The mediator will introduce herself/himself and verify that you have read and understand the mediation process.

Stage two: Clarifying each parties position: It is crucial that you are able to briefly and accurately explain your claim or defence. It is vital that you have prepared for the mediation by putting together a brief summary of your opening position. Only the key points are necessary at this stage as the longer the time taken discussing the disputed issues will reduce the time available for exploring settlement options.

Stage three: Developing options: You should have attended the mediation with a view to settling your case and this will mean both parties working to explore common ground or joint interest and working to overcome disputed issues by negotiated settlement. The mediator whilst remaining impartial will help each party to explore options and discuss risks that are common to all litigation and help parties to move forwards rather than remain in a entrenched position. The strength of the mediation process is in the hands of the parties and their willingness to listen to what each side has to say and to act accordingly in trying to reach a binding settlement.

Stage four: Building agreement: Settlement options could include monetary and or non monetary settlement options such as replacement of disputed items or rectification works to be undertaken. Whatever the outcome it must be mutually acceptable to both parties on the principle that both parties have a common interest in reaching that agreement. Simply put both parties must feel that they have gained some benefit from the mediation. Mediation is not about creating winners and losers.

Stage five: Closing the appointment: The mediator will confirm the agreement by reading the terms to each party and by asking each if they fully agree to all the terms. Once agreed this becomes a legally binding agreement and the terms thereafter cannot be varied by either party. A copy of the mediation agreement will be sent to both parties and a copy will be placed on the court file.

If after reading the above you are still unsure whether or not mediation is suitable, or if you have any other queries, please call the Mediation Team on the number below.

CompassDear Mervelee,We wanted to make sure you had the chance to join our Compass  Labour meeting with Nadia Whittome MP, on Tuesday 29 October 2024 at 6pm.Join as a member and ask Nadia your questionsA lot has changed for Labour in the last few months. They secured a historic election victory, winning power after 14 years in opposition. They formed a government to begin the process of democratic, social and economic renewal.  With their first 100 days in government almost behind them, weโ€™re looking forward – to the impending budget and beyond. This is why weโ€™re so excited to hold a Compass Labour meeting and discuss the opportunities for the new government, and how Compass can influence change. The call is open to members of all political parties. Our Compass party groups are only for Compass members, so you will need to join to register for the call.Join Nadia and Compass LabourWith better people with better ideas in place, itโ€™s up to progressives like us to drive the change we need. But, as ever, no single political party, faction or leader  can make a Good Society a reality by themselves. We have to work together to make it happen. The problem isnโ€™t just that the Labour Party isnโ€™t good enough. Itโ€™s that itโ€™s not broad enough to confront all the problems we face. No one party has a monopoly on wisdom โ€“ we should all have a say and a stake in our shared future. This is where Compass members come in. Our members are at the heart of everything we do. They want to be part of the change, they want to buy into a project and a vision that gives them a sense of hope, home and purpose.  Theyโ€™ve been deeply involved in setting our new strategy for how we fight to build a good society. You can join them on a strategy call in October, and our AGM in November.  Our members steer us – so with them we host the space to think, digest, and debate the questions that need answering. Thatโ€™s why we host our Reading Room, where members get 12 free podcasts a year and discounts on the books that have shaped, and continue to shape Compassโ€™ thinking. Twice a month, our members join us on live podcast calls with progressive thinkers, campaigns, and politicians to ask them their questions on the issues weโ€™re facing.  Previous guests include the likes of international thinkers like Yanis Varoufakis and George Monbiot, to politicians like Dawn Butler, Caroline Lucas, Lisa Nandy, and Andy Burnham, to organisers working on the ground in Preston and Cumbria. Be part of it. Become a member.Join our movementBe there on Tuesday 29th October with Nadia Whittome MP, and join the movement for a Good Society. It is worth fighting for. And that weโ€™ll only get there if we go together.
Our warmest wishes,  Lena Compass Campaigns Officer Already a member? We may have a different email address associated with your membership. • The TJHC project is being evaluated by Birmingham University so you may be asked to complete a very small multiple-choice questionnaire at the start and the end of the session. I have attached a further information form on how this data is used and an example of the short questionnaire โ€“ any questions please do let me know.

Do let us know if you have any other questions and we look forward to seeing you later!

Participant Information Sheet
Creative Arts Partnership Evaluation

  1. Invitation to research
We would like to invite you to take part in helping us to evaluate the impact of the Creative Arts Partnership project run and funded by Dulwich Picture Gallery and the Tessa Jowell Health Centre. The principal aim of this evaluation is to assess the role the arts and creativity can play in improving an individualโ€™s wellbeing and how successful the Creative Arts Partnership has been. The Creative Arts Partnership, and its evaluation, is expected to last approximately 3 years in total.
You must be over the age of 18 to take part.
  2. Why have I been invited?
You have been invited to take part because you are involved with the Creative Arts project. Around 300 participants are expected to take part in the evaluation programme, in various ways.
  3. Do I have to take part?
It is up to you to decide. We will describe the study and go through the information sheet, which you can keep. If you decide to take part, we will ask you to sign a consent form to show you agreed to take part. You are free to withdraw, without giving a reason. If you would like to withdraw from the study, please see section 13.
  4. What will I be asked to do?
If you wish to take part, you will be asked to complete a questionnaire at the start of the Creative Arts activity you are participating in and another questionnaire at the end of the activity. Both questionnaires will ask questions about your current wellbeing and the second questionnaire will ask about your experiences of engaging with the Creative Arts project. Some questions will be repeated on both surveys โ€“ the questions are asked twice so we can see if there has been any change to your wellbeing after taking part in Creative Arts activities. We ask that you please complete all questions and be honest. Your honesty will help us improve future projects.
If you engage with more than one Creative Arts activity, you will be asked if you would like to take part in the evaluation each time you engage. You can choose if you wish to take part every time. Taking part once does not mean you have to take part again. Declining to take part does not exclude you from taking part in the future, if you so wish. You are welcome to take part multiple times.
  5. Are there any risks if I participate?
There are no risks expected with participation in or because of this evaluation.
  6. Are there any advantages if I participate?
There are no direct advantages or rewards as a result of participating in this evaluation. However, your participation will be a useful contribution and could help us improve the Creative Arts Partnership project.
  7. Informed consent
Before you take part in any evaluation you will be informed what you participation will involve by reading this Participant Information Sheet. You will be given time to consider if you would like to take part in this evaluation. If you wish to take part in our evaluation, you will be asked to complete an online consent form to show you agreed to take part. The consent form must be completed before you can complete the survey.
  8. What information about me will you collect and why?
We will collect your name, age, and postcode which you will need to input on a consent form before you can complete the survey. We need this information so we can match up your โ€˜beforeโ€™ and โ€˜afterโ€™ surveys and assess if there has been a change to your wellbeing. Both surveys will ask you to share information about your wellbeing at the time you complete them, and the โ€˜afterโ€™ survey will ask you to share information about your perception of the Creative Arts project. We are collecting this data so that we can evaluate the project.
There is an optional section at the end of the โ€˜beforeโ€™ survey which asks for your gender identity, if you consider yourself to have a disability, your age group, ethnicity, and employment status, how you were referred to the programme, if you are confident to manage your health condition/disability and your biggest worries. We collect this information so we can understand more about the people taking part in the Creative Arts project, if different groups of people have different experiences of the project and because the projects funders (including the NHS) require us to ask for this information. You are welcome to leave this section blank if you do not wish to provide this information. If you decide not to provide this information, this will not have any impact on your participation in the Creative Arts project.
  9. How will my information be stored and how will you look after it?
Any data you provide will be anonymised. To do this, all participants will be given a unique code which will only be available to the researcher (Dr Faye Sayer) and university representatives. Only the researcher will have the key list which will be stored securely (via password protected documents, folders, and computer) separately from all other project documentation.
  10. How will you use my information?
The information you provide will be used to evaluate the Creative Arts programme. You will be anonymous and not identifiable in any outputs (such as evaluation reports). Any information or quotes which can identify you will not be shared.
  11. Will my data be sent anywhere else, or shared with other people or organisations?
We will not share your personal data (such as your name) with any third parties. We will share the anonymised findings of this study with Dulwich Picture Gallery, Tessa Jowell Health Centre and NHS South East London Clinical Commissioning Group (all located in the UK). The University never sells personal data to third parties.
  12. When will you destroy my information?
All personally identifiable data will be disposed of within 3 months of the conclusion of this evaluation project. Non-personal data (such as anonymised data and general findings) will be kept for the duration of the project and 10 years after the project has ended to ensure monitoring, auditing and inspections are possible if required.
  13. Data Protection Law
The way we look after your information is ruled by UK law. Under UK law, we need to have a very good reason for using your information (this is called a โ€˜lawful basisโ€™). Sometimes, we might also want to use sensitive information about you, like information about your health, religion and ethnic background. This is called โ€˜special category informationโ€™. We collect all this information from you to help with our research, which aims to benefit everyone (this means that it is in the โ€˜public interestโ€™).
You have the right to make choices about your information under UK law. If you have any questions or would like to ask us to do something with your information, you can ask the researcher or a parent or guardian, or someone else at the University. Contact details are shown towards the bottom of this document.
You can stop being a part of the study at any time, without giving a reason. You can ask us to delete your data at any time, but it might not always be possible. If you ask us to delete information before March in the year it was collected (e.g., if you completed the survey in January 2022, by March 2022), we will make sure this is done. If you ask us to delete data after this point, we might not be able to. If your data is anonymised (where we take out your name and any other information that lets us know the information is about you), we will not be able to delete it, because we will not know which data is yours. If you would like to withdraw from the study, please email Dr Faye Sayer (please see email address at the bottom of this document).
  14. What will happen to the results of the research study?
The results of this evaluation will be shared with relevant stakeholders (including Dulwich Picture Gallery, Tessa Jowell Health Centre and NHS South East London Clinical Commissioning Group) in annual monitoring reports and an Evaluation Report at the end of the project.
Who has reviewed this research project?
University of Birminghamโ€™s ethical committee has reviewed this research project.
Who do I contact if I have concerns about this study or I wish to complain?

Good afternoon

Further to my earlier email.

I have discussed your previous complaint recorded under PC/2268/24 which is currently being handled by Central South Professional Standards Unit with a supervisor on that unit.

Good afternoon MM Response: 8/10/2024

Further to my earlier email. MM Response: I am responding with the Seriousness that this deserves

I have discussed your previous complaint recorded under PC/2268/24 which is currently being handled by Central South Professional Standards Unit with a supervisor on that unit. MM Response: It would be interesting to know how you made the decision about who is handling the complaint. But I guess at this stage it’s not that relevantJust so you understand that because of the Systemic Discrimination of the past 10 years, and as the author of IN HONOUR OF STRONG WOMEN EVERYWHERE that was signed and dedicated to a #strong #jamaican #womant at the “A New Met for London #launch”. I know it’s my responsibility to myself with threats of IMPRISONMENT and EVICTION via Contempt of Court hanging over me for my “Defensive Practice”. To inform you that everything will be made public to safeguard me from being SECTION, MURDERED, KIDNAPPED in my home or on the streets of London before am ready to return home to JAMAICA.

As this complaint clearly overlaps with the previous complaint and the concerns raised are over the same time scale as the previous they are also going to be managing this complaint. MM Response: Just want you to understand that I sent a letter outlining my concerns with the Metropolitan Police handling my concerns between 30th October 2017 to 9th Auugust 2024 still stands. I will add visit on 22/9/2024 of Thiago.moreira@met.police.uk who visited on the 19/10/2023 after my husband and I were robbed in Peckham. This proves my point about the Metropolitan Police roles in the GASLIGHTING and MISOGYNY of Mervelee Myers. The various bodies from IOPC, JCIO, MOPAC will be accountable for allowing the HATE CRIMES against me. If I were you I would check the records of my claims against the Metropolitan Police and IOPC and JCIO after my complaints were not dealt with from the time I arranged a MEETING at the Southwark Police Station with Inspector Owen Pyle, and Tammie Tebboth who left Kevin Webster to handle their incompetence. For your information there are recordings on YouTube. As stated at the A New Met for London launch I am willing to VOLUNTEER to help the Metropolitan Police bring back the TRUST of the BAME communities. Instead they set out to wage a HATE CAMPAIGN with Housing for Women, Devonshires Solicitors LLP, Deborah Agnes Gilchrist and the HATE MOB in Alma Grove.  I am still open to VOLUNTEERING after I get the justice, I have been FIGHT4JUSTICE for since I invested in sharing my stories.

Please use the reference PC/2268/24 in all future emails and if you require any updates please contact the professional standards unit on the below email address. MM Response: I certainly will.

Mervelee Myers have PROOF that the Metropolitan Police is INSTITTUTIONAL RACIST and breaches my RIGHTS as a DISABLED BLACK WOMAN. And continued the GASLIIGHTING and MISOGYNY after Sir Mark Rowley signed IN HONOUR OF STRONG WOMEN EVERYWHERE at the “A New Met for London” launch. A month after Disrict Judge Sterlini labelled me a VIOLENT NUISANCE on EMANCIPATION DAY 2023.

Kind regards
