Re: Housing Disrepair and Conditions Case

As you aware we act for you in relation to your case against your landlord.

In law the burden of proof is upon you, as the claimant, to prove your case against your landlord.

We have to prove your case on your behalf as follows:-

  1. That there is actionable disrepair present at your address; and
  2. That your landlord knew of the actionable disrepair and conditions because you have personally told them or they were on notice in some other way of the conditions before we have become involved in your case.

We prove 1 by obtaining a report from a Chartered Surveyor, an expert. The Surveyor will within his report, set out the disrepair, how each and every defect needs to be addressed and at what cost.

We appreciate it can be difficult to provide all the information we need straight away but can you please gather as much material as possible – the information/evidence โ€“ and supply it, if/when you are able to do so? Evidence assists in securing early settlements and thus is crucial in every case.

In relation to 2, we need to know what evidence, if any, you hold in support of your complaints about the conditions – for example:

  1. Do you have any emails, texts or letters sent to your landlord and any reply to those complaints? If you do, please forward them. MM Response: 1. Letter dated 29 April 2019 detailed fact my husband who was a painter and decorator maintained the upkeep of the Property from he moved here in 2001. 2. Series of Messages on my Mobile with MCP Property Dated 20 March 2023 to Tuesday 1 October 2024. This is about REPAIRS carried out in the property about the REPORTS I made via telephone calls to those responsible. 3. I have had several conversations with persons from MCP about repairs to be done. I was called on the 27th October 20224 from a female about the repairs to the toilet seat. That is the date that Dr. Phil Gregory visited. 4. Reference the letter/email about the conversation with the Mental Health Nurse and H4W. I recorded most conversations and will have to track them down. 5. A COMPLAINT was lodged on my behalf about the toilet seat by an employee of H4W. The reference is included in the letter from the MH Nurse. I asked Dr. Phil Gregory to mention I showed him the DISREPAIR when he visited on the 27th October. 6. 1/2/24 H4W MCP Property Report of Electrical Faults & No Heating Call Log 325823 via email. ย

MM Response: DATA wiped from Customer Portal and I was not allowed to send anything via EMAIL. They were rejected. My complaints were documented on the CUSTOMER PANEL before the DATA were wiped out. I had seen them and added information myself.
  • Has anybody else on your behalf reported the conditions to your landlord? If so let us have names and addresses in order that we can attempt to obtain witness statements and or discuss the contact with that party? MM Response: 1. Mimi Owusu and her friend Liz came to my home and saw the condition of the place. They help me to raise concerns. But later turned against me. 2. Mimi Owusu write a 12 page Witness Statement for H4W cataloguing how she helped H4W to cover up the DISREPAIR. 3. Liz targeted me because of a photograph that was taken of me and her at the Front Door when she came to support me. 4. I was contacted by Andrew Jenkins of Talking Therapies 12/2/2022 to make Telephone appointment after Trina Philbert referred me. Because of the ongoing issues to do with the DISREPAIR. 5. The issues about DISREPAIR started when I was asked to do a SURVEY about the CONDITIONS of the PROPERTY. I was honest about the deterioration in the upkeep of the PROPERTY because I was the minute taker for the Scrutiny Customer Panel that was disbanded. I am now a member of the Housing Ombudsman Customer Panel. I was selected for my experiences and skills in advocating for others. ย ย 6. The people who advocated on my behalf are dead. 7. Hermoine Cameron who was a member of the Scrutiny Panel was advocating on my behalf. She visited my home twice, but I do not have her address or contact information. 9. Ms H Presley who is having the same problems with H4W can verify I shared my concerns with her. ย ย ย ย ย 
  • Have you kept a diary of your complaints made to your landlords? If so please let us have a copy โ€“ if there is private material in any diary/log which you would prefer not to be disclosed, we can ensure only the relevant notes/entries are disclosed. MM Response: 1. My DAIRY would have been the CUSTOMER PORTAL that was wiped of the data. 2. I started recording conversations with H4W to safeguard myself after Ms Samantha Gibbs and Trina Philbert joined their employment in 2022. 3. I have letters between Ms Gibbs and myself and done recordings that I will have to search for online. 4. I have REFERENCE about calls I made.
  • Have you used your landlordโ€™s complaints procedure? If so let us know the result? Did you know of any complaintโ€™s procedure? MM Response: 1. The complaints I raised were GENERAL about the harassment and bullying of the neighbour that would mention issues about reasons for disrepairs. 2. Other concerns of REPAIRS would have been addressed. Like when Pipes were put in by GREEDY CONTRACTORS and I refused for them to put the pipes through my flat to go upstairs. Because of the times Ms Gilchrist flooded the bathroom and H4W had to change the Electrics in the Bathroom. 3. I advocated on behalf of TESS for the pipes not to be put through her flat. After this was done the pipes were left uncovered. I had to ask for the PIPES to be boxed in as I was pulling my heavy trolley over them. 4. I had a FAULTY radiator for over a year. I have recording of the CONTRACTOR complaining to his colleague about it. 5. An electrical casing fell from the ceiling missing my husband who was sat at the kitchen table. It was in the kitchen for months because the landlord said its not their RESPONSIBILITY. They fixed it in the end. 6. The same was done about the fencing. They came to make a gate for the front instead of the back garden. 7. My brother fixed the gate when he visited for my husbandโ€™s 101 birthday. 8. The fence is still not fixed. 8. Until Ms Gibbs and Ms Gilbertย  started working for H4W when I raised concerns in a SURVEY and I was targeted by H4W, I was getting repairs sorted. 9. The major complaint would be from Ms Gilchrist broke the glass to the Communal Door on the 13th December 2021 and the length of time it takes for H4W to board it up before replacing the glass. Ms. Gilchrist broke the glass again in May after opening a letter from H4W and leaving it on the mat at my door. ย ย 
  • Have you informed any employee or contractor of the Landlord of the conditions? If so let us know when you did so and how you did so, and if you know the names of the persons please provide them. MM Response: 1. Concerns were raised in a SURVEY carried out on behalf of the landlord. ย 2. I was asked if I want the landlord to talk to me about the ISSUES raised. Considering I was the minute taker for the SCRUTINY PANEL I would be aware of concerns of my fellow TENANTS on the PANEL. I have a list of names and minutes of the meeting along with schedules for TRAINING. ย 3. I have had conversations with PEJU AWOYE about the CUSTOMER PORTAL link and matters that should be added to the portal before my DATA was wiped.
  • Do you have a Housing officer/Manager who is in contact with you about your tenancy? Have you told that person about the disrepair and conditions?ย  If you have, can we have their name(s) and when you have told them. MM Response: 1. Relationship with H4W broke down after Ms Gibbs and Ms Philbert joined in 2022. 2. Ms Candy Smith of Southwark Adult Social Care interviewed my husband and upon hearing of our concerns agreed to mediate on our behalf. Ms Smith arranged the meeting with H4W and visited with Ms Trina Philbert in June 2022. Ms Philbert was the new Housing Officer who started working with H4W in May 2022. I showed Ms Gilbert the property inside and out. I have correspondences between us. I did recordings, but I am not sure I uploaded them online. 3. I have spoken to CONTRACTORS about getting reports when they visited but they are not allowed to give me. I have to go through H4W. 4. On 12th January 2023 Ms Gibbs bring a male to my door to introduce as my New Housing Officer. He tried to assault me so I moved back inside. 5. The Police were called. 6. H4W set out to harass, bully and intimidate me for raising complaints to the Housing Ombudsman Service about the overall failures and DISCRIMINATION at the PROPERTY. ย ย 
  • Have you told your GP about the disrepair and conditions? If so, when? MM Response: 1. The GP was aware of the ongoing issues with the landlord. This is one of the reasons I was kicked out of the Nexus Health Group and left without a GP. 2. In getting an injunction to evict and imprison me H4W made allegations about my MENTAL and PHYSICAL HEALTH using the 12 pages witness statement of Mimi Owusu. 3. I was asked to do Psychiatric Assessment and complied. The GP was asked to provide a Medical Report which she did in the end. 4. I have seen other Practitioners and have reports. 5. I am waiting on the report from Dr. Phil Gregory who visited my home on the 27th October 2024. ย ย 5. I was locked out of the Communal Door on the 23/10/2024. Luckily I have someone with me, who got the neighbour to open the door. 6. The Police refuse to visit I have recordings.
  1. Has anybody from your landlord or its contractors been to your home and had sight of the disrepair and conditions? MM Response: 1. The landlord is only interested in getting the neighbour to TRIGGER me. They visit to remove the mats my husband bought from we meet in 2001 after leaving letters. The mats were to protect us from things going in the house. ย 2. Debris from the neighbours window with nails sticking out fall into the garden This was health hazard to my husband and myself whenever we are in the garden. 3. Rubbish was thrown in the garden to upset us. 3. My husband invested in the back and front gardens. Out of spite Ms Gilchrist started cutting the front garden. I came from Church the first time it happened to see her at her window taking photos. When I went inside my husband was sat at the window crying. He said she saw him there and taunted him. I went outside and cursed her. She cut the garden again and I swear at her, before realising what she was doing to me. 4. Each time the garden grows she cuts it down and I refused to react. Because she has plants in her windows at the back and front. 5. A CAMERA has been installed to monitor my movements to harass, bully and intimidate me. I no longer feel safe living at the property. I am a PRISONER in my own home I got through DOMESTIC VIOLENCE because I raised concerns using the Landlordโ€™s Policy and Procedures. And even seeking support from the Housing Ombudsman Service. Instead of the support I was expecting I am accused of making it up. ย ย

I am dealing with the fact I was labelled a violent nuisance a year ago despite the proof online about the systemic discrimination denying me my ENTITLEMENTS. ‘Repairing Trust’ Call for Evidence

The Housing Ombudsman is exploring common issues in housing maintenance, following a significant rise in complaints about disrepair. This โ€˜Call to Evidenceโ€™ will help us to understand how increasing repairs costs, complaints and skill shortages are impacting residents’ safety in their homes.

The ‘Repairing Trust’ report will highlight some of the positive changes landlords have made to rise to the maintenance challenge and explore the complex relationships between landlords, contractors, and residents, with a particular focus on accountability, roles, and responsibilities. It will examine the experiences of operatives on the ground as well as residents and the breakdown in relationships that can happen between the landlord and residents.

The โ€˜Call for Evidenceโ€™ will remain open for over 12 weeks, closing on Friday 25 October 2024, supported by casework reviews and fieldwork across England.

We are seeking insights from residents, repair operatives, landlords, contractors, MPs, and councillors.

The questions in each survey will cover:

  • What are the main issues landlords face when contracting services, what causes these issues, and what impact do they have?
  • What problems do residents encounter with these services, the underlying reasons, and their effects?
  • What barriers do operatives experience in delivering services, the root causes, and the repercussions?
  • What are the lessons learned from cases with no maladministration and successful initiatives within the sector?

The Judges were intent on FRUSTRATING me that they strike out my Claim against VOICE the UNION after I was contacted by two Solicitorโ€™s Firms after putting in a DEFENCE. Ms Winsome Duncan was in the Gambia on another of her scamming mission and did not accept the ORDERS. Iโ€™d seen her via YouTube.

Ms Duncan since set up TV Channel on Facebook, so I commented. This prompted her to call me when I was doing YouTube Live. So, whatever I said was captured if her voice was not captured.

The POLICE Involvement

I reported Ms Duncan to the Metropolitan Police after she verbally abused me out by TEXCO on 16 October 2019. But they refuse to act, because I have CLAIMS against them and the IOPC too.

I was unable to access LEYF websites so got the REVIEWS after the ET finished from Winsome Duncan with whom I have an Engagement Agreement.  As can be verified one by Jyoti Sharma was posted during the ET. She is mentioned in the Claimantโ€™s Witness Statement. I used the REVIEWS in the EAT. But JCIO agreed I made up DISABILITIES. But Justice Ingrid Simler who sent my CLAIM to the EAT with CAVEATS agreed Judge Shanks dealt with FACT. Yet she was in Daily Express advocating for CRIMINALS not to be DEPORTED to Jamaica. But I have been made a criminal despite using Subject Access Request proving that the Employment Tribunal Services presided over the second miscarriage of justice against me. This book is dedicated to my mother; she was a strong woman, who took on many roles when she faced challenges.  

To my aunt Marty Nembhard aka Evelyn Bailey who told me the history of my Nembhard family when I visited her in St. Ann.    

To my aunt Tilyn Nembhard aka Icylyn Powell one of three children born to my grandmother Irene Mills-Nembhard and only sibling of my father who is alive. Auntie Tilyn must be recognised for her contributions to Jamaicaโ€™s Cultural Capitals and Independence whilst she is still alive. I will take the accolades for creating the legacies freeing the future generations of my families from the โ€œMental Slavery of Traumasโ€ inflicted on us. Especially the females who bore their suffering in silence.  The โ€œGenerational Curses of my Dysfunctional Familyโ€ must be addressed sensitively so my granddaughter does not suffer the same faith as the females have down the ages. From my ancestors were sold into slavery and experienced โ€œMultiple Discriminationโ€.   

To Mervelee Ratty Nembhard-Myers-Tomlinson for challenging the systemic discrimination that made me a criminal needing Emotional Regulation Treatment to cover for abusers. A Violent Nuisance during the time I was experiencing CRISIS of losing a brother to cancer, another spending his sixty (60) birthdays in the hospital โ€œIntensive Careโ€ and me having to call out the

Ambulance Service. At the same time caring for my elderly husband. As Camilla Tominey the former Daily Express columnist states, โ€œTech Donโ€™t Lieโ€ and the fact I am a writer is key to my survival.  

My intellectual property, copyright, images and CPPDP harvested by social media will not stop me from sharing my stories. The Judiciary of England and Wales, the Criminal Justice System and Crown Prosecution Service will be named and shamed for putting children, young people and elderly adults at risk of safeguarding. Will they continue covering for the A-Z of abusers by imprisoning and evicting me from the home I got because of โ€œDomestic Abuseโ€?

A special thanks to my husband for his support and understanding. Without him this book would not be possible. Age one-hundred years and one month (101), my husband stood the test of time. However, no one deserves to be traumatised for supporting his wife.  He died in Kings College Hospital NHS Foundation Trust on BYRON ward, where a male nurse by the name of John was the only person to take care of him.

                    PREFACE 

This is the story of Mervelee Myersโ€™ transitional journey which started after the birth of my youngest sibling Ervin Julius Emster Nembhard on the 11th of November 1966. My stories of experiencing โ€œMultiple Discriminationโ€ are documented online therefore, I must sign post the reader to read how I am managing to survive after the death of my mother, who experienced dementia. Mum meets her challenges throughout her life, as a loving daughter, sister, wife, mother, grandmother, auntie, and friend. In the latter stages, she was struck down by dementia and despite me making the diagnoses from the United Kingdom after hearing about her behaviours which were causing concerns to the family. I was not prepared when I got home for my sonโ€™s wedding, to find mama as the vulnerable woman who relied upon others for meeting her every needs. However, most painful of all was the fact that mama did not know her only daughter.  

I was comforted by the fact that I had the opportunities to help my mother to revisit her life when she was the strong woman. Taking care of the need of others at the expense of her own emotional wellbeing. A glimmer of recognition came the day I was leaving Jamaica, when she told my son, โ€˜She did not come to say goodbyeโ€™.  It was then I realised this was our final physical goodbye and the next time I saw my mother would be in death.  

My name is Mervelee Myers, this is my story. I want to tell the world how the transitional journey that I have been on the past ten (10) years was predicted by a stranger whom I meet at my aunt Phyllis Salmon aka Mellie Nembhard home in January 2014. This man of God was visiting my auntie and prayed for me. I want to use my story as a testimony for others not to accept giving up as an option.

So much has happened to me in the past ten years including the deterioration in my mental and physical impairments. I refused to be gag when my stories are documented online.  Those responsible will be named and shamed as my mother always say, โ€œPrison was not made for animals, but for humankindโ€. When am finished, the criminals needing Emotional Regulation Treatment and violent nuisances will be named.      

ABOUT THE AUTHOR

I was Merveleeโ€™s tutor when she registered for the Edexcel Level 2 Certificate in

Supporting Teaching and Learning in Schools (QCF), as a Teaching Assistant. The

LSA course lasted five months, from January โ€“ May 2016. When I first met Mervelee, she was a bit reserved and told me she is more of a background person. However, I could identify Mervelee as a more knowledgeable practitioner from the beginning, by the way she engaged, socialized, and interacted with her peers. Merveleeโ€™s peers could also identify her for being cooperative, reliable, and dependable professional, who supported and was willing to share her knowledge as a learning partner.  

Mervelee was appointed by her group to lead the presentation for the first group project. It was evident that Mervelee is a natural leader and influencer, who is willing to spend time supporting her peers to reach their individual potential. I encourage Mervelee to continue using and sharing her knowledge to empower others. Mervelee was open and honest with me about her Mental Health Issues and informed me she was undergoing counselling. Mervelee said she did not want any misunderstandings, as some days are very bad. She was determined to get back to good health and into working.

Mervelee established positive relationships with her peers, encouraging them to do their best. Her sense of humour was appreciated, especially as she was the Mother Figure for the group. Mervelee talked about managing her disabilities with diet and exercise, without relying too much on medication and was an inspiration to all. Her work was above the required standards, and she took great pride in the presentation of her assignments.  

Mervelee expressed her wish to do further studies and was planning to enrol on the Higher-Level Studies program to gain her Teaching

Qualification/Assessor Award. Mervelee has done volunteering, and I know she is ready to be back working. The acceptance by her peers enabled Mervelee to regain some of the self-confidence she lost over the time she experienced her personal crisis. We are continuing the collaborative working partnerships developed using our shared visions and knowledge to promote inclusion, empowering others to reach their potential. Mervelee is growing from strength to strength and regaining her confidence.  

Mervelee confided that she finds it difficult going back into a toxic environment, where she will be judged by others and feel threatened. The unfair treatments have left Mervelee feeling vulnerable. Mervelee said her vulnerability caused her to question her abilities and function as a more knowledgeable reflective practitioner who developed the listening ethos. Mervelee said she was advised about the benefits from a career change. She decided to return to studying to gain the necessary qualifications to get back into employment.  

Although her confidence was destroyed after the years, she spent managing her hidden disabilities to become a graduate at 50-years-old, she wants to get back working. Work keeps her going and gives her a sense of self-worth. As a Counsellor, I have been supportive of Merveleeโ€™s endeavours and determination to get back into working, even if not full-time. Merveleeโ€™s peers were supportive of her, and those with whom she volunteered were grateful for her help. They have given their blessings to Merveleeโ€™s future endeavours. I believe Mervelee Myers can manage an Early Years Setting, with her qualifications, training, experiences, and passion she has shown for her subject area, whilst doing the Teaching Assistant course. Mervelee continues to empower herself to

the highest levels-with her ongoing Continuing Personal Professional Development Plan (CPPDP).

I can vouch for Mervelee Myers as a professional, who is passionate about accomplishing and achieving whatever she sets out to do. Since meeting Mervelee, she has shown her professionalism, to be cooperative. She uses her initiative to empower those she works with in whatever capacity. I would highly recommend Mervelee Myers.

Doing the research  

Personal Perspective:  

I was empowered to do research into Special Educational Needs and Disabilities (SEND) from a personal perspective as part of studies to become a graduate. The following chapters of my book will reveal sensitive details that can be found in the public domain owing to the nature of the jobs I have signed contracts for. Due to the personal circumstances of how I came to deal with the SEND Code of Conduct, I realised that there were other factors which were having an impact upon my transitional developments since puberty. In Honour of Strong Women Everywhere will go a long way in highlighting some of the myths and old wivesโ€™ tales, associated with SEND. One of my mantras about Special Educational Needs and Disabilities (SEND), is that in some rare cases it cannot be seen with the naked eyes. Many people who have experienced SEND issues will discover that there is evidence that if there is no โ€œEarly Intervention Strategiesโ€ starting in childhood. Children can face additional traumas from their disabilities if left untreated. Although my โ€œChildhood Traumas โ€“ Hidden Disabilitiesโ€ were not addressed by professionals, I found my own โ€œEarly Intervention Strategiesโ€ in writing from an early age.    

It took me enhancing knowledge via studies, my working and personal experiences and even being a participant in โ€œThe Experiences of Multiple Discriminationโ€ (Maria Hudson 2012) for me to share my contributions which is/was a part of my research into โ€œA Voice of a Childโ€. A project I conducted for LEYF CEO June Oโ€™Sullivan in 2010. Coming after Dr. Maria Hudsonโ€™s research paper when I was interviewed at my home. It took the unfair treatments at work and advised to seek counselling by Dr. Laura Crawford when I was sent on medical suspension in breach of the contract I signed. For me to find out how much oneโ€™s life can be affected by SEND Issues. Therefore, I would advise everyone to educate themselves about the issues that may impact upon how one is able to live a fulfilling life.  

I grew up in rural Jamaica with a family that was affected by disabilities, prolonged sicknesses and suffering as well as poverty. Without knowing what was happening to me, my father was struck down with Parkinsonโ€™s disease from an early age. I was going through the transitional developmental stages from puberty onwards and my life was turned upside down as a result.  I ended up becoming one confused little girl who could not understand that my fatherโ€™s so-called God, could allow him to be sick and leave his family to suffer. I was the one, who was severely affected. Due to the trauma, I took on the signs and symptoms of my fatherโ€™s sickness and was unable to perform in the public.  I bore the brunt of being labelled as worthless and struggled through school. But if you ask my schoolmates and my teachers, they will tell you that I was bright and I have the certificates to prove it! Knowing my deficits and limitations, I stay out of situations that would trigger the severe symptoms.  

I considered myself different from others. Thatโ€™s why I am an advocate of INCLUSION, implementing and promoting of the Early Intervention Strategies.

In my roles as the EYFS coordinator, SENCO, and Multigenerational Working Approach Facilitator. Please do not wait for the horse to escape from the paddock, before trying to mend the fences or locking the gate, if you do you will miss your blessings. The evidence is conclusive that SEND conditions which are present from childhood if not dealt with in line with the SEND Code of Conduct can blight the lives of individuals into adulthood. I am proof that it happens, Google is where my experiences and life stories are documented. However, I must make it clear that I am/was the victim of โ€œSystemic Institutional Discriminationโ€ that triggered my Post Traumatic Stress Disorder after I experienced bereavement and losses. My wishes are for my readers to benefit and to be inspired.   

I was diagnosed with โ€œChronic Anxietyโ€ on Monday 18th July 2006, for my Health and Social Care examination with the (Open University 2004-2010). Because I did not have a medical diagnosis for Parkinsonโ€™s disease.  To date, I was only able to get treatment after the Occupational Health Doctor pass me fit for work when concerns were raised about alleged behaviours that were not deemed normal. The doctor advised me to get counselling to find out why I react the way I do to certain situations. I have since had counselling from the professionals at the Maudsley Hospital. Although I am not cured, I am in control of my life once more and I am nearly back to before the time when my father took sick.

 The issues addressed 

1.1      Sources of information  

  1. I assessed Mervelee Myers for the purpose of this report in my consulting rooms at Keats House on 15 April 2024.ย  I explained to her that as it is a court report, the usual patient/doctor confidentiality accorded does not apply in this case and she understood this.

 My investigation of the facts 

2.1       Family history  

  • She told me that her father died on 9 February 1980, aged 62 years, he suffered with Parkinsonโ€™s for over 10 years. She described him as a common labourer. He was married and she said that she enjoyed a good relationship with him.
    • Mother died on 1 June 2014, aged 90 years, she suffered with dementia. She was married and did not work outside the home when married, she became the carer to her husband. She described her mother as very strict but enjoyed a good relationship with her.ย  ย 
    • She said that she is the seventh of a sibship of nine, two females. ย 
    • Balis was born in 1946, he is a married retired tailor and factory worker, who has three children. She described a good relationship with him. He lives in Florida. She told me that he goes back and forth to Jamaica. ย 
    • Youvanney, died five or six years after birth, she had epileptic fit.ย  ย 
    • Dostan died in 2003, aged 73 years, he had cancer. He was a retired tailor and marketing inspector, he was married and had four daughters. She said that their relationshipย โ€œwas a bit up and downโ€. He lived in Jamaica. ย 
    • Byron died in 2008, aged 56 years, he had cancer. He worked in a youth centre, he was married and had four children. She described a good relationship with him. ย 
    • Texchus is a 70-year-old, married, retired police officer who lives in Jamaica. He has three children. ย 
    • Ashter was born in 1956, he died aged 37 years in 1994, he had AIDS. He was married, but the marriage did not last long. He had two children. He was a local government councillor in Jamaica, before he went to America where he did chef work. She said thatย โ€œHe is my favourite brotherโ€. ย 
  • Mervelee Myers. ย 
  • Amly was born in 1963, married, he has four children and worked in construction in America until 2023. He had a blood clot in his head and was in intensive care. She described a good relationship with him.
    • Ervin was born in 1966, married, he has three children. He is a teacher in America. She described a good relationship with him. ย 
    • Paternal aunt suffered with mental illness. She was unaware of a family history of substance abuse but said that Ashter died in jail. ย 

2.2       Personal history  

  • She told me that she was born in Jamaica and was unaware of perinatal abnormalities. She lived with her parents as a child and described a happy childhood.
    • She said that she attended schools from about six years, enjoyed school, had friends at school and denied truanting. She left school at 16 years, when she got pregnant. She sat seven to eight local exam subjects, over a period of time, she obtained credit to pass. She went on to evening classes between 17 and 19 years, when she passed English O Level. ย 
    • She subsequently did domestic work in her twenties, for short periods of time. She stopped in her twenties when she became a basic schoolteacher. She started work as a basic schoolteacher at 27 years, before this, she did one-year national youth service, as a teaching assistant, and worked as a basic schoolteacher when she finally came to the UK in 1992. ย 
    • The chronology became a bit confusing from here on. She told me that she met someone in Jamaica, came to the UK in 1991 on a holiday, to find out if she could live in the UK. She went back in June 1991; she finally came to live in the UK in 1992.ย  ย 
  • According to her, when she came on holiday in 1991, she did cleaning jobs, when she returned in 1992, she went back to the same cleaning jobs, and was in various cleaning employment from 1992 until 2005.
    • She then said that she went to college from 1997 to 1999 to study childcare, obtaining a nursery nurse qualification, and was the student of the year. ย 
    • She then said that from 2004 to 2010, she studied with the Open University, childcare, obtained a foundation degree in 2009, and went back to do some more childcare training, called children and families. ย 
    • She did early morning cleaning from 1992, throughout college until 2005, when she decided she could manage financially and did not need the money. ย 
    • From 1999, she worked as an early years practitioner, at different places until 2015. She told me that she has not been in paid employment from 2015, and she survives on benefits.ย  ย 
    • She described herself as heterosexual and she denied sexual abuse. She has been married twice. ย 
    • Her first marriage was on 20 October 1992 to Malachi in London, he was born on 28 May 1930. He was a minicab operator. She has no children by him. They were divorced in 2002. ย 
    • The second marriage was on 21 May 2014 to Arnold, in London, he died on 8 April 2024 aged 101 years 1 month, from old age. She has no children by him. ย 
    • She told me that she has two sons in Jamaica by two fathers. ย 
    • Kevin born in 1976, is a married local councillor in Jamaica, he previously worked in banking. He has two children. She described a good relationship with him.ย  ย 
    • Valdin was born in 1979, he is married and has four children. He is a teacher, and he was a FIFA referee. She described a good relationship with him. ย 
    • She told me that she has no other children. She chose not to have more children, because of her DNA, (citing Parkinsonโ€™s disease and diabetes).

She told me that her sons were not planned.  

  • Sometime in the interview, she mentioned that she has a stepson by her husband, Trevor aged 61 years, she is not sure if he is still married to his wife, he has one son. He works in Brixton prison.
    • She told me that she has never smoked cigarettes, she drinks alcohol on social occasions and denied use of non-prescribed or illicit drugs. ย 

2.3       Forensic history  

  • I have not seen a record of previous convictions recorded against her, but she reported the following to me, not in a good chronological order.
    • She said that on 30 November 2020, the police attended her home,ย โ€œBeat me up, assaulted me, took me out half nakedโ€. According to her, the police called the evening before to tell her she was required at the Walworth police station, for an interview on 1 December 2020. She said that she had a prior appointment that day, to do with her diabetes. She requested for another appointment. She told me that four officers visited, she thought they were there to listen to her argument. ย 
    • She said that she was charged with criminal damage to property. She was fined ยฃ50.ย  ย 
    • She said that in January 2023, she was at home, it was her motherโ€™s birthday, so she dressed up in her cultural clothes and was celebrating. She wanted to put all that had happened to her, behind her and move on, the police attended her home. She said that they made allegations that there was a report of an incident at her address on 10 January 2023. She refuted this, she could not recall this happening. She said that one of the officers, went out and came back, and changed the reason why they were there. In the interim, she was issued papers telling her to attend Croydon Magistrates Court, if she did not attend, she would be arrested. She was given a date to attend Walworth police station for an interview. The next day, 27 January 2023, she went to Croydon Magistrates Court with her husband, nothing was listed. She asked questions, eventually, she spoke to somebody. She had to return to court twice after that. On the third visit to the court, no further action was taken, she was sent a document relating to her mental health.ย  ย 
    • On 3 February 2023, she said that she went to Walworth police station with her husband, she was represented by a duty solicitor, that was when she was told her neighbour returned from work at 1500 hours, heard screaming and shouting. The neighbour went to her flat, which is above hers (Mervelee Myers), opened her window, and she (Mervelee Myers) cursed her. She said that this is still being investigated to date. ย 
    • According to her, both the neighbour and her male partner, have kicked her door, this started in November 2023, and is still going on. She told me that she called for assistance from the police the day the equipment was being installed at her home, for her husband to be discharged from hospital. The kicking of the door, she stated happened sometimes three times a week, she has reported to the police, and was provided card numbers. ย 
    • On 27 February 2024, she told me that she called the police three times, because the kicking of the door was getting to her, no-one turned up. She was indoors, did not hear the communal doorbell ring, she then heard knocking on her door. She asked who it was, they said that it was the police. She opened the door; police officers were stood there. She thought because she had called three times, that is why they attended. She told me that some of the officers asked if she knew Arnold Tomlison, her husband, she invited them in. She stood there waiting for them to come in, she saw one of the officers, put something at the door. She asked what it was, it was a battering ram, no-one answered her. She thinks four officers went into her property, maybe more, she asked for the purpose of their visit. She told me that she suffers with anxiety, she became anxious when she saw the battering ram. She was then told that the visit was about a video she posted online. She told me that she posted a video online because she blogs, she has signed up for a speaking event on 28 April 2024. She stated that,ย โ€œI am expert authority on subjects from cradle to grave. So, my tag line is early intervention is key to survival. Because I work with childrenโ€. She said that the video is there as part of her speaking engagements. The video was made in Jamaica, because her husbandโ€™s sister was going through a transition (dying), her husbandโ€™s niece, explained about her mother falling out of bed. She (Mervelee Myers) advised her niece that she has to safeguard her mother. ย 
    • She then said that in terms of sensitivity, she did not post the video until after her sister-in-law died. She told me that the police saw the video, and because of their perception of her, she does not know who is feeding the police the information. She said one of the officers asked if she remembered him, he then told her that he remembered her husband, because he had visited, when her husband and herself had a disagreement. At this point, I asked if there was domestic violence between them, and she said no. She told me that she chose to report the incident, as a means of safeguarding both, because her husband was traumatised by the death of her mother. Her husband raised his walking stick to hit her. The police eventually left, but she reported the matter. ย 
    • She then said that in 2017, she called the police because she was verbally abused by two persons, one of them stole her manuscript, the other one, a barrister, was ordered to pay back the money he took from her, by the Court, as he did not represent her. According to her, the police did not act, stating that,ย โ€œIt was none of their businessโ€.ย  ย 
    • She told me that on 30 October 2017, the police and ambulance turned up at her house to section her for a malicious report, that she wrote on Facebook that she was feeling suicidal. She told me that she arranged a meeting with the police at the police station, she wanted her stepson to be present. He was not able to join the meeting, which took place with her alone. The police did not come prepared. One officer said to her, that if she did not calm down, she would be placed in a strait jacket. She told me that she came out of the meeting upset, her stepson arrived later, he was waiting outside. She said that the stepson went back into speak to the police. She said that whilst waiting outside, a police vehicle pulled up, stating they received a report that someone was misbehaving. According to her, nothing happened further with the police. She said that her stepson was still talking to them. Nothing else happened with the police on that day. ย 

2.4      Medical history  

  • She told me that in 2012, she was diagnosed with diabetes. She is not on medication at present. She tries a holistic approach. She said that takes metformin when advised to do so.
    • She said that she was diagnosed with arthritis in 2012 and she is receiving treatment. ย 
    • She said that she was diagnosed with high blood pressure in 2023, she is not medication. ย 
    • She said that in 2016, she did 12 sessions of counselling for depression and chronic anxiety. ย 
  • She told me that she has not been on prescribed medication by secondary mental health services. She is not on any medication at present.
    • I obtained the following from the medical records provided to me.ย  ย 
    • Dr Laura Crawford, Occupational Health Physician, Health Management, in a letter dated 29 April 2015 to Ms Dilys Epton, HR, London Early Years Foundation thanked her for referring Ms Myers to Health Management for occupational health advice regarding her fitness to work and the impact of medical conditions on work. The letter summarised her physical condition. It is of note that the letter stated that she admitted that she had an anxious personality and is certainly likely that many of the symptoms she described are related to that. The letter stated that in terms of her anxiety, she was progressing some counselling therapy, having been given contact details both via her GP and via work. The letter stated that it is hoped that some counselling treatment might help her understand what triggers and symptoms, help her to manage them, and help her to moderate how she reacts when becoming anxious for example the loud speech and the tremor.ย  ย 
    • Laura Tinsley, Trainee Counselling Psychologist, South London & Maudsley

NHS Foundation Trust, Southwark Psychological Therapy Service, Middle

House, Maudsley Hospital, London SE5 8AZ in a letter to the GP, stated that Mrs Myers attended a course of 12 counselling sessions, and they had a final session on 26 February 2016. The PHQ-9 score on 10 April 2015 was 22 and the GAD was 7, the PHQ-9 score on 26 February 2016 was 5 and the GAD-7 score was 7. These are measures for anxiety and depression. The letter stated that Mrs Myers attended her sessions and engaged well throughout the course of treatment. The treatment focused on Mrs Myers depression, following her difficulties at work. Mrs Myers cause for depression and anxiety significantly reduced over the course of treatment as stated in the letter.   

  • The plan and recommendations included an agreement that Mrs Myers did not require further treatment from SPTS at the time. However, Mrs Myers could always be rereferred or self-refer, if she required further treatment in the future.
    • The GP in a letter dated 17 March 2016 addressed to whom it may concern, stated that the letter was confirming that the above named attended the surgery on 6 February 2015. She said that she had been suffering for about one month with anxiety, poor sleep and low mood due to problems at work.ย  ย 
    • On examination, she was found to be slightly anxious. She was advised to use a self-certificate to sign herself off work for the first week and given the telephone number to ring for a local self-referral counselling service. She was reported to have attended the surgery again on 13 March 2015, saying that she had problems with stress at work. She had counselling at Southwark Psychological Therapy Service where she had 12 counselling sessions with a final session being on 26 February 2016. ย 
    • The letter went on to state that she attended the surgery again on 29 February 2016 to discuss having a medical report done.ย  ย 
    • It was reported in a letter dated 8 July 2016 from South London & Maudsley NHS Foundation Trust Talking Therapies, Southwark, to Ms Myers, addressed to whom it may concern, that she attended 12 counselling sessions at Talking Therapies Southwark. It was reported that she stated that she has suffered with chronic anxiety since she was a child. She said that she had learnt to manage the anxiety, but it did sometimes affect her ability to write as she has a tremor in her hand. She, however, stated that this did not affect her work.ย  ย 
    • She reported that her depression seemed to have arisen in the context of a difficult period at work. She said that she felt unfairly treated and she could not understand how her colleagues had come to form their opinions about her. ย 
    • The letter stated that over the course of treatment, the impact of her work situation was explored with her, and how it affected her. The impact of this situation on her marriage, where Mrs Myers found it hard to cope as a result of being overwhelmed by the difficulties in her work life. She also said that this had affected some of her friendships. It was reported that Mrs Myers said that her family were her main support, but this was only over the telephone due to the distance between them. ย 

2.5      Mental state examination (15 April 2024)  

  • She was appropriately dressed, was cooperative and there was good eye contact. There was no disorder of movement or posture. Her answers to questions were appropriate, but she was at times overinclusive, with the intention of going into great details about events.
    • She felt well in herself and there was no clinical evidence of a primary mood disorder. She said that she has been sleeping well. According to her, she developed an anxiety disorder in the past three years, sometimes only drinking water. I asked if she has consulted her GP. She said thatย โ€œI told him about itโ€. However, she said that eats when she needs to. She had no thoughts of harm to self or others. ย 
    • She denied auditory or visual hallucinations. She denied delusions of thought insertion, withdrawal or broadcasting. She denied delusions of reference, persecution or grandeur. ย 

There was no formal thought disorder.  

  • Cognitively, she had good remote and recent memory, regarding immediate recall, she was able to recall four out of a six-item address. Her attention and concentration were subjectively good, she was able to count from 10 backwards and able to name the months of the year backwards but missed out April. She was well orientated.ย  She had good knowledge of current affairs, she was able to name the British prime minister, the American president and the King.
    • She does not consider that she is currently mentally ill or in need of treatment. ย 

2.6      Further information obtained from Mervelee Myers  

  • I asked if she had any questions. She asked if I think she is mentally ill. I said that I would need to reflect on the assessment and peruse her medical records.
    • I formed the view that she can take in information, weigh it, and come to a reasoned decision. She can communicate her decision. ย 

Opinion and recommendations 

  • I will now respond to specific questions asked by instructing solicitors in the letter of instruction dated 11 March 2024.
    • I should be grateful if your report dealt with and addressed the

following; please avoid expressing a view regarding the factual disputes in this case, as this is of course the province of the Court and no findings of fact have been made in this matter:  

  • Assess Ms Myersโ€™ mental capacity, in particular whether Ms Myers has capacity to litigate and in making this decision please assess whether Ms Myers suffers from any mental health condition and any disabilities and whether Ms Myers has the ability to:
    • I assessed Ms Myers for the purpose of this report in my consulting rooms at Keats House on 15 April 2024 as instructed.ย ย 
    • She has been reported to have suffered with anxiety and depression, for which she received counselling sessions with good effect. She is currently on no treatment. ย 
    • In my opinion there is no evidence that Ms Myers suffers from an enduring mental illness, as defined in the Eleventh Edition of the Classification of Mental and Behavioural Disorders by the World Health Organisation, from my examination of her and the facts available to me. ย 

 3.4 Comprehend the course of the proceedings she faces so that she can make proper defence.

 3.5 Understand and reply rationally to the allegations she faces.

THE LANDLORD COERCED THE NEIGHBOUR TO TARGET ME AND MY ELDERLY HUSBAND AFTER SHE CHANGED FROM THE KIND PERSON WHO HELPED US INTO AN ABUSER.  WE ENDURED 23 YEARS OF DISCRIMINATION FROM THE NEIGHBOUR.
I AM NOT SAFE IN MY HOME, I HAVE HAD TO BARRICADE INSIDE ON A FEW OCCASIONS. 
THE NEIGHBOUR’S PARTNER STARTED KICKING THE DOOR.
THEY INSTALLED CAMERAS TO HARASS AND BULLY ME INSIDE THE COMMUNAL AREA.
THE POLICE JOIN THEM WHENEVER I CALL FOR HELP, IF THEY BOTHER TO COME OUT.
THE LANDLORD TAKE ME TO COURT AM FACING IMPRISONMENT AND EVICTION.
I HAVE BEEN ASSAULTED AT MY DOOR BY THE LANDLORD’S EMPLOYEES.
THE LANDLORD REFUSED TO MAKE REPAIRS AFTER I WAS TARGETED
THE PLACE IS IN DISREPAIR I LIVED WITH A SINK THAT OVERFLOWED WHEN I USE THE WASHING MACHINE. THEY FIXED IT.
NOW THE TOILET IS TO BE REPLACED AFTER IT FLOODS THE PLACE. THE ENGINEER PUT IN THE REPORT ABOUT THE WORST PLUMBING HE HAD SEEN.

Please confirm HfWโ€™s reason for refusing to pay ยฃ181.35 for the cost of the GP report requested by H4W and Devonshires when H4W have previously paid for other tenants medical reports from their healthcare providers? You must all be so proud with joy and pleasure causing me more financial burden and hardships, doing everything and anything to deteriorate my mental health and leave me for dead! 

As a charity H4W truly have no shame or remorse for their corruption, incompetence, racism, sexism, disablism, discrimination and victimisation, the risks, harm and danger like a controlling abusive and coercive perpetrator trapping me, my son and others like Mervelee and the woman from Childers street who was evicted having been neglected, failed and discriminated or like Barbara, failed during the pandemic like Mervelee and many others with H4Wโ€™s toxic, harmful economic and financial abuse and exploitation, refusing to pay the GP cost for the report requested specifically by H4W who invalidated my disabilities and mental health as irrelevant, decisions made by women, many whom are older women, who have been through the perimenopause land menopause themselves long ayak yet as women they continue to be misogynistic, cruel, derogatory and demeaning to disregard, minimise and invalidate mine and my sonโ€™s health made worse by the prolonged and persistent inequalities created and caused between H4W, Lewisham council and Lewisham Labour whom seem to be unable to comprehend common sense, integrity, decency, compassion, respect, humanity or empathy despite the sufficient evidence already provided to H4W which resulted in my rehousing being put up to the highest priority need in 2018. 

The harmful, discriminatory controlling, coercive economic and financial abuse against me and my son, being humiliated, discriminated and victimised, put at risk, depriving us of repairs, safety, dignity, equality, diversity, inclusion, being derogatory and disrespectful over our culture, disregarding, violating and invalidating my ethnicity as unrecognised with our cultural needs, beliefs, mental health and disabilities being ignored over repairs and our human rights and shamelessly building up court costs of over ยฃ30,000 reduced now ยฃ20,000 for whichI am liable for, was done out of pure hatred with full intentions to cause my mental health conditions to severely deteriorate and risks of suicide to increase and harm me and my son to have more control over us and trap us further as punishment for my complaint made on 19 May 2022 to Damien Egan.
The stigma and prejudice from H4W is deplorable, dehumanising and demeaning.

Please confirm who made the decision to refuse to contact my GP directly and the name of the social worker H4W made a referral to? 

Why are you unable to provide the names of the people dealing with mine and my sonโ€™s Safeguarding at H4W and the suicide prevention officer for adult social services at Lewisham council? 
Itโ€™s very easily accessible for you as you have full access to my files, along with having a duty of care and responsibility and have had no issues with sharing details with other tenants, MP, Cllrs, council officers, the HOS about those involved in our cases as contractors and staff have been openly discussing and sharing details as well as continuing to share false and inaccurate information with neighbours and tenants Iโ€™ve never met, wrongly lying that we have refused access for repairs despite us giving access to every person sent to the property including multiple unannounced visits. Would you like me to share the ring doorbell footage of the evidence of access being given to the adult social worker or the Safer Neighbourhood Team for Met Police? With the multiple inaccurate and false information being shared and stored on files and poor and inaccurate record keeping repeatedly and details on the Equality Impact Assessments, are H4W going to correct their records and notify the ICO about the non compliance?

You yourself have had meetings with Lewisham council officers and Lewisham Labour for how long now?
As the housing officer, Lewisham council officers, Cllr Will and caseworker for Vicky Foxcroft have been having regular meetings with H4W including yourself following my complaint to Damien Egan on 19 May 2022 and the home visit from Cllr Will on 17 June 2022 so you should know about the multiple victims and households for domestic abuse and hate crimes who still live here as well as perpetrators and who from Lewishamโ€™s Safer Neighbourhood Team from Met Police deal with our area however having lived here since 2012, we have never had visits despite the meetings, number of incidents and number of people repeatedly put at risk and victims and survivors who are ignored. 

Please kindly do look into who is dealing with the VAWC & community safety from Met Police, Safeguarding at H4W and Lewisham council as they have  already dealt with very similar cases like Atrium House in New Cross, Sion House In Lewisham, Childers street where a woman was failed and neglected during the pandemic, like Mervelee and Barbara and itโ€™s deeply concerning that despite my complaint on 19 May 2022, no lessons have been learned following the death of Barbara Tannoh on 12 April 2022. 
Or Sarah who died from an overdose in 2016 and left for dead for how long before her poor body was discovered and removed in a body bag.

You should know how many boxes and materials are needed as whichever department dealing with the 4-5 households who moved our permanently to a new home, I assume it would be the same as theirs. Itโ€™s not hard for you to look up the data to find put what was provided to neighbours who moved out considering the high number of households who have moved out of Childers and here permanently so send whatever you deem appropriate.

As you have informed me that you have previously made a reasonable adjustment request that was agreed to by H4W, I have enquired with management about this, so that I am fully aware of what has been agreed.

Your request in relation to the timetable, schedule of works and companiesโ€™ information and your further requested information in regards to matters under the repairs department, has been passed onto the property services department and they will contact you directly.

In regard to your SARs request, this has been passed onto the governance department for review and will contact you directly.

In regards to your request for the ASB Risk Assessment report held by us, that you previously requested this will be looked into and you will be provided with a separate response. 

As your neighbourhood officer, I do not deal with repairs or any repairs functions, this is all dealt with by the property services department and their officers.

I am unable to give you an answer in regard to your question about perpetrators and offenders. I am unaware of incident this relates too, I do apologise.  

In relation to your upcoming decant, your requests above, do not impact on your upcoming decant. I have asked you to provide me with the number of boxes you will need to help aid your move as I am unable to ascertain the number of boxes you will need alone for your belongings. I have arranged for 7 of each box size box to be delivered by our removalโ€™s contractor to your flat. 

Your box delivery will be Friday 23rd February 2024 between 10am โ€“ 12pm.

Please do inform me if you need any more boxes other than those provided to aid you.

The disproportionate und unreasonable legally binding discriminatory court order was granted because TJR Ventilation wrongly accused me of bullying him with Alyshia Watson telling the judge and the court that Tim refused to replace the extractor fan outstanding since 2018 if I was present in the property and that he would only carry out the repairs with me and my son removed.
The court and judge were also told that all companies working for Housing for Women have refused to work in the property we live in if I am present and no contractor would carry out any repairs with me or my son in the property despite A2Z Repairs allowing multiple households to keep their furniture and belongings in their homes as well as giving households permission to remain in their homes instead of using Flat 7, the hotel property to decant to, as stated by A2Z contractors it is safe for tenants to remain in their homes overnight with their belongings. 

Please can you provide written confirmation from all the companies and staff members who refuse to attend our home as the judge wrongly assumed I would follow men around in the property filming them which as my housing officer you know is not true as the ring doorbell outside and inside our hallway has proven the truth as you know weโ€™ve had to take additional security measures due to the domestic abuse and hate crimes ignored in our building where we have been personally targeted as well as being verbally abused and threatened by a violent domestic abuse perpetrator. There should be a record of this on H4Wโ€™s files for my account along with a record of all the rest of the incidents of ASB we have lived with since 2012. Youโ€™ll recall I had asked you personally for a copy of the ASB Risk Assessment Reports held for me and my son since 2012, I am yet to also to receive the reports held nearly a year on? 

As the housing officer who has been dealing with the flooring project since it started by A2Z Repairs and the multiple repeat inspections we have had since the flooring repairs were first wrongly carried out and botched up by A2Z Repairs LTD, you should know the number of boxes and materials required as the witness statement from Alyshia Watson stated 14 properties out of 38 properties were booked to have the flooring redone again. 

I note you have failed to respond to my questions how many perpetrators pose a risk to me and my son as well as our neighbours and confirm how many known offenders are living at Gosterwood and Childers? The data from the police should not be difficult for Housing for Women to obtain along with the data given to MPโ€™s, Cllrs, Lewisham council and the reports made to H4W?

Itโ€™s very disappointing to hear that you have been trying to call to discuss the upcoming decant when you are fully aware that I do not accept phone calls and part of my request for reasonable adjustments was for contact and communication to be in writing. Please therefore refrain from disrespecting and disregarding my request previously agreed by Housing for Women and refrain from making any contact via phone calls. You are also fully aware I do not have any credit therefore any text messages sent like previously by your contractors or staff will not be responded to.

Can you please put in writing what you wish to discuss about the discriminatory decanting and please explain why my neighbours were given permission to keep their furniture and belongings in their homes during their flooring repairs being carried out by A2Z Repairs LTD and why we are being victimised and forced to pack and remove everything out of the property? 

There is plenty of evidence from neighbours proving they were given permission to keep their furniture and belongings in their homes.

Why are you asking me how many boxes we need? My neighbours were not made to box and pack everything up while they were also given permission to remain in their homes instead of using Flat 7 that is being used as a hotel room?
Only three households were made to pack and empty their homes due to being permanently rehoused away from here.

Please confirm how many perpetrators continue us to pose a risk to victims and survivors still living here and on Childers including victims of other hate crimes?

Thank you for contacting the Housing Ombudsman Service, I am sorry to hear about your housing issues. MM Response: This is a lame excuse and I will ensure the world knows why.
In your initial contact with us under the above case number on 4 August 2022 you
asked us to assist you with a complaint to your landlord about outstanding repairs
and you also mentioned Anti-Social Behaviour (ASB).
After several unsuccessful attempts at asking you to provide evidence of your
complaint so we could assist you, we wrote to the landlord on 7 November 2022
asking it to confirm if there was an active complaint regarding ASB and to provide a response to you. MM Response: This is the Housing Ombudsman DEFAMATION of my NAME and the world will be informed. Because HOS is responsible for allowing H4W to get away with destroying the lives of vulnerable tenants and their families. A case in Point is Ms H Presley. HOS is just using this tactics because I am sharing stories online despite the UNLAWFUL INJUNCTION threats of IMPRISONMENT EVICTION for CONTEMPT of Court.
The landlord issued a stage one response to the complaint on 14 November 2022
and we also sent a copy of this to you the following day. We explained at the time,
and several times since, that for us to investigate your complaint you must also
complete stage two of the landlordโ€™s complaint process. MM Response: Let me just say that HOS seem to be treating me like HMCTS that presided over the miscarriages of justice https://www.gov.uk/employment-tribunals-decisions/ms-m-myers-v-london-early-years-foundation-2300047-2016 and the world will know.
We then had no contact from you between 15 November 2022 and 8 August 2023, when you called to ask where your case was up to. We confirmed, as before, that we were waiting for you to complete stage two of your landlordโ€™s complaint process before we could progress your case further. MM Response: I will not waste my time as I seeking likeminded TENANTS to form an ADVOCACY PANEL to expose LANDLORDS getting cover from the HOS to destroy our lives.
We have received many emails from you since, but you have not provided us with
any evidence that you have yet completed the landlordโ€™s complaint process. To
assist you, we contacted the landlord on 24 January 2024 to ask if you had
completed its complaint process. MM Response: Why 24 January 2024. Let me inform you that was the date Ms Presley was denied her RIGHTS and demanded to pay H4W ยฃ30,000.00 because HOS failed her. If she had commited SUICIDE the HOS would be responsible.
The landlord has now replied and confirmed it has not had any request from you to complete a stage two review of your complaint. Now that the stage one response is more than 14 months old since it was completed on 14 November 2022, we must ask you to log your concerns as a new complaint. MM Response: The LANDLORD is a TERRORCELL that will be exposed. To support you, I have written to the landlord today asking it to do so for you. MM Response: By now HOS must realise who is Mervelee Myers and what I have been doing to resolve this matter. I contacted the Rev Rose Hudson-Wilkin to mediate because I meet her at H4W AGM April 2014 after coming back from Jamaica and saying my final goodbyes to my MOTHER. I would advise HOS to go online and do the RESEARCH.

I see you have also, over time, added new issues to the case (such as eviction) that
did not form part of this case when you logged it with our service. MM Response: This just proves my ARGUMENT about HOS NEGLIGENCE allowing LANDLORDS to DISCRIMINATE against TENANTS.

please log these issues a complaint with your landlord first so that we may assist you further and provide us with copies of the complaint. Please find below confirmation we have now asked the landlord to log and respond at stage one to your concerns surrounding the original issue, anti-social behaviour. MM Response: I have been through this already.
The complaint
I understand your complaint relates to the following:
๏‚ท The landlords handling of reports of anti-social behaviour, primarily noise
from a neighbour MM Response: It was not only NOISE, its 22 years of TERRORISM by my neighbour and her JUNKIE FRIENDS. H4W wiped the Customer Portal after Samantha Gibbs coerced Ms Gilchrist to target me.
I understand to resolve your complaint, you have asked your landlord to:
๏‚ท To address the noise MM Response: If it was only NOISE, I have lived with this for 22 years. Everything that happened since Ms Gilchrist broke the glass on 13 December 2021 is logged with the Police that is party to the HATE CRIMES.
๏‚ท To respond to the complaint
I understand you have not received a response from your landlord since you last
contacted it about your complaint. MM Response: The LANDLORD is a TERRORCELL that will be exposed with HOS NEGLIGENCE.
We encourage local resolution of disputes, using the landlordโ€™s complaint procedure. MM Response: HOS is NEGLIGENT and is on the side of the LANDLORDS against TENANTS.
I have contacted your landlord today and asked it to provide you with a written
response to your complaint by 21 February 2024. MM Response: Please update about where my HUSBAND and I are. Please send a representative to the County Court at Clerkenwell and Shoreditch at 10.00 AM for the HEARING.
We will not be taking any further action on your complaint unless:
๏‚ท You inform us after 21 February 2024 that you havenโ€™t received a written
response from your landlord MM Response: Refer to above, because if I did not get a SOLICITOR I would end up like Ms Presley.

When we receive one of the above from you, we will be able to determine the next steps for your complaint. MM Response: HOS has just SHOOT itself in the FOOT or HEAD and this will form part of my STORIES about how my 100 year old HUSBAND has been let down in a SOCIETY that allowed him to beaten, his jaw broken because of the colour of his skin. His solicitor was told “Mr Tomlinson has a small illusion of one day becoming a property tycoon.
